Official Rules
Dates: November 1, 2009 through November 1, 2010
1. NO PURCHASE NECESSARY. Contest begins 12:01 a.m. November 1, 2009 and ends 11:59 p.m. November1, 2010. For purposes of these Official Rules, all times are Pacific Daylight Time (PDT).
2. ELIGIBILITY. Open to legal residents of the 50 United States and the District of Columbia. Void in Puerto Rico and where prohibited or restricted by law. If the winner is under the age of 18, the winner's parent or legal guardian must give consent. Entrants under the age of 13 may not participate in this contest (for protection under COPPA), we apologize in advance if this disappoints you, but we are bound by U.S. law to protect your privacy. Employees, directors, officers, agents’ officers and consultants and members of the immediate families and persons living in their households of each of Becky Bones LLC, their advertising and promotion agencies involved with this promotion, and their respective parent companies, licensees, subsidiaries, or affiliates are not eligible to enter. The contest shall be staged in compliance with all applicable federal, state, and local laws and are void to the extent they are not in compliance.
By entering, participants release Becky Bones LLC, Becky Bones, and their respective parent companies, licensees, subsidiaries, affiliates, directors, officers, contractors, employees and agents from any responsibility and all liability whatsoever for any injuries, losses, death or damages of any kind caused by participation in the Contest.
3. HOW TO ENTER. Access the Becky Bones.com website (http://www.Becky Bones.com), go to the "Design Your Own T-shirt" page, and follow the directions. All participants must complete the registration form when they post their entries into the forum section of the site (which is the way you enter your design). If you are under 18 years of age, register first and last name, e-mail address, mailing address, telephone number, date of birth, and parent/guardian's e-mail address and/or telephone number. Minors under the age of 18 who are selected to be on the “Designer of the Month” BeckyBones.com website page will also be required to provide Becky Bones with a Parental Permission Form, which will be sent to the parent/legal guardian's e-mail address. The Form must include a parent's or legal guardian's signature and must be returned by mail or email to an address provided on the Form within seven (7) days of notification in order to be eligible to be featured on the “Designer of the Month” BeckyBones.com website page. Any minor who does not provide this Parental Permission Form within seven (7) days will forfeit his or her right to be featured on the “Designer of the Month” BeckyBones.com website page, and an alternate winner will be selected.
PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES, OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE CONTEST OR A DELAY IN THE PROCESSING OF ENTRIES. BECKY BONES IS NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.
4. SUBMISSIONS AND POSTINGS.
4.1 By submitting, sending, posting, displaying, performing and/or otherwise distributing Submissions to BeckyBones.com, you hereby grant us and our designees a worldwide, non-exclusive, sublicensable (through multiple tiers), assignable, royalty-free, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), create derivative works of, publicly perform, publicly display, digitally perform, make, have made, sell, offer for sale and import such Submissions in any media now known or hereafter developed, for any purpose whatsoever, commercial or otherwise, without compensation and without an obligation to report to the provider of the Submissions, and waive all moral rights (including any rights to attribution) that you may have in such Submissions. You further agree that we and our designees shall exclusively own all documents, works and other materials that incorporate all or part of any Submission(s). As such, you agree that Becky Bones, LLC has the rights to obtain copyrights and/or trademarks for any artwork submitted by you.
4.2 You acknowledge and agree that other persons, including BeckyBones.com employees and contractors along with others who have or will make Submissions, may have submitted or may submit in the future Submissions that are similar to the Submissions submitted by you. You acknowledge and agree that you will not receive any compensation because of BeckyBones’ use of other similar Submissions. You agree that no confidential or fiduciary relationship is established between you and BeckyBones.com as a result of your submission. Becky Bones has no obligation to show, use or distribute your Submissions.
4.3 You represent and warrant to BeckyBones.com that (a) the Submissions do not and will not infringe any rights of any third party(ies), and that the Submissions do not and will not libel, defame, or invade the rights (including, without limitation, the right of privacy or publicity) of any third party(ies); (b) all obligations relating to the Submissions have been satisfied, including, without limitation, those with and relating to artists and personnel, licenses, and laboratory and other contracts; (c) you have the right to enter into this Agreement and to grant the rights granted or agreed to be granted hereunder; and (d) you have made all necessary payments (and no additional payments are required to be made) to any and all guilds, unions, performing rights societies, bodies and/or groups representing actors, writers, directors, composers, musicians, artists, and other persons who participated in the production of the Submissions.
4.4 We have no obligation to monitor the Site or any Submissions, postings or other materials that you or other third parties transmit or post on the Site. You acknowledge and agree that we have the right (but not the obligation) to monitor the Site and the materials you transmit or post; to alter or remove any such materials; to disclose such materials and the circumstances surrounding their transmission to any third party in order to operate the Site properly; to protect ourselves, our BeckyBones.com members and visitors; and to comply with legal obligations or governmental requests. The information and opinions posted in materials on the Site are not necessarily those of Becky Bones or its affiliates, and BeckyBones.com makes no representations or warranties regarding such posted materials. We neither endorse nor are responsible for messages or statements, or for any opinion, advice, information or other utterance made or displayed on the Site or Forums by third parties, whether such third parties are visitors to the Site, members of the Site or others. We are not responsible for any errors or omissions in articles or postings, for hyperlinks embedded in messages or for any results obtained from the use of such information. Under no circumstances will we or our suppliers or agents be liable for any loss or damage caused by your reliance on such information obtained through the Site.
4.5 We may take down submissions, whether in the forum section of the site, or the “Designer of the Month” section of the website, at any time, and subject to our sole discretion.
5. CHANGE OF E-MAIL ADDRESS POLICY. It is the sole responsibility of the entrant to notify the Contest judges in writing or by e-mail if the entrant changes his/her email address. 6. PRIZES. One (1) monthly winner will be selected by Becky Bones beginning on or about December 1, 2009 from all eligible entries received by September 23, 2009. Odds of winning depend on the total number of eligible entries received. The contest winner will be featured on the “Designer of the Month” BeckyBones.com website page.
7. SELECTION OF WINNERS. By accepting the prize of being featured on the “Designer of the Month” BeckyBones.com website page, except where prohibited, all winners grant to Becky Bones and their advertising, press, and marketing agencies the right to use and publish his or her proper name, likeness, artwork, picture, voice, opinions, biographical information, and state and announce winner's name, home city, and state in any media to promote Becky Bones and the contest without compensation. If a selected winner cannot be contacted, is ineligible, or fails to return in a timely fashion a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized accountholder of the e-mail account. Becky Bones reserves the right to disqualify any person, or e-mail address, that Becky Bones determines to be in violation of any term contained in these Rules. By accepting a Prize, winners also release Becky Bones their directors, officers, agents, employees, officers, licensees and consultants and their marketing and promotion agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt of the Prize.
8. CONDITIONS OF PARTICIPATION. Becky Bones is not responsible for misdirected mail, incorrect or inaccurate capture of entry information, including but not limited to malfunctions, human error, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect, failures of: any telephone or computer line or network, computer equipment, software, or any combination thereof. Entry materials/data that have been tampered with or altered are void. In the event that this Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Becky Bones reserves the right to cancel, terminate, or suspend the Contest.
Potential winners will be notified by e-mail and/or phone and may be required to complete, sign, and return an Affidavit of Eligibility/Release of Liability and Publicity Release (where legal). If potential winner does not reply to such notification, the notification is undeliverable after up to three attempts and/or the Affidavit and Releases are not returned as instructed within seven (7) days of their transmission, potential winner will be disqualified and an alternate winner will be selected. Once the Affidavit of Eligibility/Release of Liability and Publicity Release (where legal) are received and verified by Becky Bones, confirmed winners will be featured on the “Designer of the Month” BeckyBones.com website page.
In the event that a potential winner is a minor under the age of 18, his/her parent or legal guardian will be notified by e-mail and will be required to sign and return via email or to an address designated in said e-mail, a Parental Permission Form (signifying permission for the minor to be declared a potential winner) as well as the Affidavit and Releases. In the event that this notification is returned as undeliverable, Becky Bones will attempt to re-send up to three times. If the Parental Permission Form, the Affidavit, and Releases are not returned within seven (7) days of their transmission, or should the e-mail after three attempts be returned as undeliverable, such potential winner will be disqualified and an alternate winner will be selected. All responsibilities of a minor will be assumed by his/her parent/legal guardian.
All entrants, as a condition of entry, agree to be bound by these official rules and by the decisions of the contest administrators which shall be final and binding in all matters relating to this contest.
